1. ABOUT THESE TERMS

These Terms of Service ("Terms") apply to your use of The Cardboard Addicts website and online store, which can be accessed via the URLs of thecardboardaddicts.com, 010u6g-m1.myshopify.com, mister-e-collectables.myshopify.com, misterecollectables.com, www.misterecollectables.com, www.thecardboardaddicts.com, thecardboardaddicts.com.au, www.thecardboardaddicts.com.au (collectively, the "Website"). 

In these Terms, "Cardboard Addicts", "we", "us" and "our" means Sasha Bello trading as Cardboard Addicts (ABN 99 391 237 527), a sole trader business based in Queensland, Australia.

"You" and "your" means the person accessing the Website or purchasing products from us.

These Terms, together with any policies expressly incorporated into them, govern your use of the Website and purchases made through it.

By using the Website or placing an order, you agree to these Terms.

If you do not agree to these Terms, you should not use the Website or purchase products from us.

Nothing in these Terms excludes, restricts or modifies any right, remedy, guarantee, warranty or protection that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law contained in Schedule 2 to the Competition and Consumer Act 2010 (Cth) ("ACL").

Where a provision of these Terms is inconsistent with a mandatory legal right or obligation, the mandatory legal right or obligation prevails to the extent of the inconsistency.


2. ELIGIBILITY AND USE OF THE WEBSITE

You must be legally capable of entering into a contract to purchase products from us.

If you are under the age of majority in the place where you live, you may only use the Website or place an order with the involvement and permission of a parent or legal guardian.

You must provide information that is accurate, complete and current when placing an order or creating an account.

You must not:

  • use the Website for any unlawful purpose;

  • provide false, misleading or fraudulent information;

  • impersonate another person;

  • interfere with the operation or security of the Website;

  • attempt to gain unauthorised access to our systems;

  • introduce malicious code or other harmful material;

  • use automated means to access the Website in a manner that interferes with its operation;

  • scrape or systematically copy substantial portions of the Website without our permission;

  • infringe our intellectual property rights or those of another person; or

  • engage in conduct that may cause harm to us, our customers or third parties.

We may restrict or suspend access to the Website where reasonably necessary to protect the Website, our business, our customers or third parties, including where we reasonably suspect fraud, abuse, unlawful conduct or a security risk.

Any restriction or suspension is subject to your rights under applicable law.


3. OUR PRODUCTS

We sell collectible trading cards, sealed products, graded cards, memorabilia and other collectible products.

We make reasonable efforts to ensure product descriptions, photographs, prices and other information displayed on the Website are accurate.

However, the appearance of products may vary slightly from photographs due to lighting, photography, display settings or other factors.

Where a listing uses a representative or stock image, the image is intended to illustrate the type or product represented and may not depict the exact item supplied.

Where a listing states or reasonably indicates that the photograph depicts the exact item for sale, the product supplied will be the item represented by that listing, subject to any disclosed variation.

Product descriptions, photographs, condition descriptions, quantities, serial numbers and other information forming part of a particular product listing apply as they appeared at the time the relevant order was accepted.

We may update product descriptions and Website information for future purchases.

We will not use a later change to a product listing to retrospectively alter the product that you purchased.


4. COLLECTIBLE CONDITION

Collectible products may have characteristics that differ from ordinary retail goods, including manufacturing defects, print variations, centring variations, surface marks, edge or corner imperfections and other characteristics associated with the production, storage or age of collectible products.

Where we provide a condition description, that description forms part of the product information applicable to the relevant listing.

For raw or ungraded cards, condition descriptions are our assessment based on the information reasonably available to us and are not a guarantee that a third-party grading company will assign the same grade or assessment.

For graded cards, the grade displayed is the grade assigned by the relevant grading company.

We do not guarantee that a third-party grading company would independently assign the same grade to a graded collectible.

Where a product has a disclosed defect, imperfection, alteration, damage or other condition issue, that information will be taken into account when determining the product supplied and your rights under applicable law.

A disclosed defect does not prevent you from exercising any right you may have in relation to a different defect or a failure to comply with a consumer guarantee.


5. AUTHENTICITY AND THIRD-PARTY GRADING

Unless expressly stated otherwise in the product listing, we sell products as authentic products of the type described in the listing.

We do not guarantee the future value, investment performance, resale value or future market price of any collectible.

Where a product has been graded, authenticated or encapsulated by a third party, the third party's authentication or grading is its own assessment.

We are not responsible for changes in the market value of a collectible after purchase.

Nothing in this section limits any representation we have expressly made about the authenticity or characteristics of a product or any rights you have under applicable law.

If you reasonably believe a product may not be authentic or may materially differ from its description, you should contact us as soon as reasonably practicable so that we can investigate the matter.

We may request photographs, documentation, expert assessment or return of the product for examination where reasonably necessary to investigate an authenticity or product-description dispute.


6. ORDERS AND CONTRACT FORMATION

When you submit an order through the Website, you are making an offer to purchase the products identified in your order.

Submitting an order does not by itself guarantee that we will accept the order.

An order becomes accepted when we send you an order confirmation indicating that the order has been accepted, or when we otherwise clearly communicate that the order has been accepted.

We may decline an order before acceptance for legitimate reasons, including where:

  • the product is unavailable;

  • there has been an obvious pricing or listing error;

  • we reasonably suspect fraud or unauthorised payment;

  • we reasonably suspect an attempt to circumvent a purchase limit;

  • the order cannot lawfully be supplied or delivered;

  • the delivery destination is unavailable;

  • we reasonably suspect a sanctions or export-control issue; or

  • circumstances outside our reasonable control prevent supply.

If we decline an order after payment has been taken, we will refund the amount paid for the affected order.

Once an order has been accepted, we will generally supply the products in accordance with the order, subject to your rights and our rights under these Terms and applicable law.


7. CANCELLATION BY YOU

You may contact us to request cancellation of an order.

We will consider cancellation requests made before dispatch where reasonably practicable.

Cancellation is not guaranteed merely because a request has been made.

Nothing in this section limits any right you have to cancel a contract or obtain a refund under the ACL or other applicable law.

Where an order has already been dispatched, cancellation may not be possible and the applicable returns or refund process will apply.


8. PURCHASE LIMITS AND BULK ORDERS

We may impose reasonable purchase limits on particular products, including limits per customer, household, account, payment method, delivery address or other reasonably identifiable purchasing group.

Purchase limits may be imposed to prevent unfair purchasing practices, automated purchasing, stock manipulation, fraud or attempts to circumvent stated limits.

We may cancel or adjust an order before acceptance where we reasonably determine that a customer has attempted to circumvent a purchase limit.

Where an order has been accepted, we will not rely on this section to remove any mandatory consumer right.

We may contact customers regarding large or unusual orders to confirm order details, payment information or intended use.


9. PRE-ORDERS

Where a product is offered as a pre-order, the expected release or dispatch date is an estimate unless expressly stated otherwise.

Release dates may change due to circumstances outside our control, including manufacturer, distributor, supplier, production, shipping or allocation delays.

A pre-order does not guarantee that a manufacturer or distributor will supply the exact quantity originally expected.

If we cannot supply a pre-ordered product, we will notify you and refund any amount paid for the affected product, subject to any greater rights you may have under applicable law.

Where an order contains both pre-order and immediately available products, we may specify whether the products will be shipped together or separately.


10. PRICES

Prices displayed on the Website are in the currency stated at checkout or on the relevant product listing.

Prices may change before an order is accepted.

The price applicable to an accepted order will be the price communicated at the time the order is accepted, subject to any correction required by law.

We take reasonable care when displaying prices. If a price is displayed incorrectly, we will deal with the error in accordance with applicable law.

Where an incorrect price is identified before an order is accepted, we may contact you to explain the error and, where appropriate, allow you to decide whether to proceed at the corrected price.

If the law requires us to honour a displayed or advertised price, these Terms do not limit that obligation.

Promotional offers may be subject to additional terms disclosed with the relevant promotion.


11. PAYMENT

You must provide valid and authorised payment information when placing an order.

You represent that you are authorised to use the payment method provided.

Payment may be processed by third-party payment providers.

We may decline, suspend or investigate a transaction where we reasonably suspect fraud, unauthorised use, payment abuse or other unlawful activity.

Nothing in this section limits your rights under applicable payment, consumer or financial services laws.


12. SHIPPING AND DELIVERY

We currently offer delivery to selected Australian and international destinations.

Available delivery destinations, methods and costs will be displayed at checkout where applicable.

Delivery timeframes provided on the Website are estimates unless expressly stated otherwise.

Delivery may be affected by circumstances outside our reasonable control, including carrier delays, customs processing, weather, natural disasters, industrial action, government restrictions and other events beyond our reasonable control.

If we fail to deliver within the time required by applicable law, or within a reasonable time where no specific time has been agreed, you may have rights to a remedy under applicable law.

We are responsible for taking reasonable care in preparing products for shipment.

Nothing in these Terms transfers to you any risk or liability that cannot lawfully be transferred.

For Australian consumer purchases, your rights under the ACL apply to goods that are lost, damaged, defective or otherwise fail to comply with consumer guarantees.

If you believe an order has been lost, damaged or incorrectly delivered, contact us so that we can investigate.


13. DELIVERY TO INTERNATIONAL DESTINATIONS

International orders may be subject to customs duties, taxes, import charges, clearance fees or other charges imposed by the destination country.

Unless expressly stated otherwise at checkout, these charges are not included in the product price or shipping charge.

You are responsible for complying with applicable import requirements in your destination country.

We cannot guarantee that a particular product will be permitted into every country.

If an order cannot lawfully be imported into the destination country, you should not place the order.

Where an international parcel is returned, abandoned, destroyed or otherwise dealt with by a customs authority or carrier because of the customer's failure to comply with applicable import requirements, we will assess the circumstances and any refund or other remedy in accordance with applicable law and our Refund Policy.

Nothing in this section excludes any mandatory consumer right.


14. DAMAGED OR MISSING ORDERS

If an order arrives damaged, please contact us and provide photographs of:

  • the product;

  • the packaging;

  • any visible damage;

  • the shipping label; and

  • any other information reasonably requested by us.

Where an order appears to have been lost or delivered incorrectly, we may investigate the matter with the relevant carrier.

You should retain the product and packaging until we have completed any investigation where reasonably practicable.

We may request reasonable evidence to assist with an investigation.

A request for photographs, evidence or inspection is an investigation procedure and does not remove any consumer guarantee or other statutory right.

Where a product has a major failure, or another remedy is required under applicable law, we will provide the remedy required by law.


15. RETURNS, REFUNDS AND CHANGE OF MIND

Our Refund and Returns Policy forms part of these Terms.

Our change-of-mind return policy, if any, is separate from your statutory consumer guarantee rights.

Unless our Refund and Returns Policy expressly provides otherwise, a change of mind does not by itself create a right to a refund under the ACL.

Nothing in our Refund and Returns Policy or these Terms excludes or limits your statutory rights.

We will not refuse a refund, replacement, repair or other remedy where you are legally entitled to that remedy merely because a product is sale stock, discounted, on promotion or otherwise subject to a store policy.


16. AUSTRALIAN CONSUMER LAW

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

The ACL provides additional consumer guarantees relating to matters including acceptable quality, fitness for disclosed purpose, correspondence with description and other matters.

Where a product has a major failure, you may have the right to reject the product and choose a refund or replacement.

Where a product has a minor failure, we may generally choose to repair, replace or otherwise remedy the problem as permitted by law.

We may reasonably assess a product before determining the appropriate remedy.

Nothing in these Terms requires you to deal with a manufacturer instead of us where the law makes us responsible for providing a remedy.


17. CHANGE OF MIND

If we offer change-of-mind returns, the terms applicable to those returns will be set out in our Refund and Returns Policy.

A change-of-mind return policy does not replace or limit your statutory consumer guarantees.

If a product has a problem covered by a consumer guarantee, we will deal with the matter under the applicable consumer guarantee rather than treating it merely as a change-of-mind return.


18. PRODUCT INFORMATION AND DISCLOSED DEFECTS

We may sell products that have known characteristics, imperfections or defects that are disclosed before purchase.

Where you were clearly informed of a particular problem before purchase, you may not be entitled to a remedy under the ACL for that same disclosed problem, to the extent permitted by law.

This does not prevent you from exercising rights in relation to a different problem that was not disclosed.

For collectible products, you should carefully review photographs, condition descriptions and other information before purchasing.


19. MARKET VALUE AND INVESTMENT DISCLAIMER

Collectible cards and other collectibles can fluctuate substantially in market value.

We do not guarantee:

  • future market value;

  • investment returns;

  • resale value;

  • future grading outcomes;

  • future demand;

  • scarcity;

  • appreciation; or

  • profitability.

Any discussion of market value, rarity, investment potential or expected appreciation is general information only and is not financial advice or a guarantee of future performance.


20. INTELLECTUAL PROPERTY

The Website and its content, including text, graphics, photographs, logos, designs, layout, product descriptions and other materials, are owned by or licensed to us or used with permission, unless otherwise stated.

You may access and use the Website for personal and lawful purposes.

You must not reproduce, modify, distribute, commercially exploit or create derivative works from our Website content without our permission, except where permitted by law.

Nothing in these Terms transfers ownership of our intellectual property to you.

Third-party trademarks, logos and intellectual property remain the property of their respective owners.


21. CUSTOMER REVIEWS AND FEEDBACK

If you submit a review, testimonial, photograph, suggestion or other feedback to us, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that material for the purposes of operating, promoting and improving our business.

You retain ownership of your material.

You represent that you have the necessary rights to provide the material and that it does not unlawfully infringe another person's rights.

We may remove or decline to publish content where reasonably necessary, including where it is unlawful, misleading, defamatory, abusive, fraudulent, irrelevant or otherwise inappropriate.

We will not edit a genuine customer review in a way that materially changes its meaning in order to mislead consumers.


22. THIRD-PARTY SERVICES AND LINKS

The Website may use or link to services provided by third parties, including payment providers, delivery providers, technology providers and social media platforms.

Third-party services may be subject to their own terms and privacy policies.

We are not responsible for the operation of a third-party service to the extent that the matter is outside our reasonable control.

Nothing in this section excludes any liability that cannot lawfully be excluded.


23. WEBSITE AVAILABILITY

We aim to keep the Website available and functioning properly but do not guarantee uninterrupted or error-free operation.

The Website may occasionally be unavailable because of maintenance, technical problems, security incidents, updates or circumstances outside our reasonable control.

We may modify, suspend or discontinue features of the Website.

Where reasonably practicable, we will take reasonable steps to minimise disruption.


24. FRAUD, PAYMENT DISPUTES AND ABUSE

We may investigate transactions where we reasonably suspect:

  • fraud;

  • identity or payment misuse;

  • unauthorised payment;

  • false delivery claims;

  • abuse of refunds or returns;

  • repeated attempts to circumvent purchase limits;

  • manipulation of promotions;

  • account abuse; or

  • other unlawful or dishonest conduct.

We may request reasonable information or evidence to investigate such matters.

Where permitted by law, we may refuse future transactions or restrict Website access where we reasonably determine that continued transactions present a material fraud, security or legal risk.

Nothing in this section prevents a customer from exercising a genuine statutory right, disputing a transaction in good faith or contacting a payment provider or regulator.


25. EXPORT CONTROLS AND SANCTIONS

We may refuse or cancel an order where supplying the product would breach applicable Australian sanctions, export controls or other laws.

We may also refuse an order where we reasonably suspect that the transaction involves a sanctioned person, prohibited destination or prohibited end use.

Where we cancel an order for this reason and payment has already been taken, we will refund the amount paid to the extent permitted and required by law.

You must not use, resell, re-export or transfer products in a manner that you know or reasonably suspect would breach applicable sanctions or export-control laws.


26. PRIVACY

We collect and handle personal information in accordance with our Privacy Policy.

Our Privacy Policy explains what personal information we collect, why we collect it, how we use and disclose it, how we protect it and how you can contact us about privacy matters.

Where third-party providers, including Shopify, payment processors, delivery providers or other service providers, process information on our behalf, their own privacy terms may also apply.

Nothing in these Terms limits any privacy rights that apply to you under mandatory law.


27. LIMITATION OF LIABILITY

To the maximum extent permitted by law, we are not liable for loss or damage arising from matters that are not caused by our breach of these Terms, negligence, wrongful conduct or failure to comply with a mandatory legal obligation.

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by our negligence;

  • fraud or fraudulent misrepresentation;

  • liability that cannot lawfully be excluded or limited;

  • a failure to comply with a non-excludable consumer guarantee; or

  • any other liability that cannot lawfully be excluded or limited.

To the extent permitted by law, we are not liable for loss caused solely by:

  • your misuse of a product;

  • your failure to follow reasonable product instructions;

  • your provision of incorrect delivery information;

  • events outside our reasonable control; or

  • your unlawful or unauthorised conduct.

Nothing in these Terms limits your right to compensation for reasonably foreseeable loss or damage where that right arises under the ACL.


28. EVENTS OUTSIDE OUR REASONABLE CONTROL

We are not responsible for delays or failures caused by events outside our reasonable control, including natural disasters, severe weather, war, terrorism, industrial disputes, government restrictions, major telecommunications failures, cyber incidents affecting essential infrastructure, carrier failures, customs delays or other circumstances that could not reasonably have been prevented or avoided.

This section does not remove any consumer guarantee or other mandatory legal right.


29. INDEMNITY

To the extent permitted by law, you are responsible for losses reasonably incurred by us as a result of your unlawful use of the Website, fraud, intentional misconduct, infringement of a third party's rights, or material breach of these Terms.

You are not required to indemnify us for loss caused by our negligence, breach of these Terms or failure to comply with a non-excludable consumer guarantee.

We will take reasonable steps to notify you of a third-party claim for which an indemnity is sought where doing so is reasonably practicable.

Nothing in this section creates liability for you that cannot lawfully be imposed.


30. ACCOUNT TERMINATION AND WEBSITE ACCESS

We may suspend or terminate an account, or restrict access to the Website, where reasonably necessary because of:

  • fraud;

  • unlawful conduct;

  • material breach of these Terms;

  • security concerns;

  • misuse of the Website; or

  • conduct that materially threatens our business, systems or other customers.

Where reasonably practicable, we will provide notice before restricting access.

Immediate restriction may occur where we reasonably believe it is necessary to prevent fraud, security threats, unlawful conduct or other material harm.

Termination or suspension does not affect rights or obligations that arose before termination.

Any consumer guarantee or other statutory right continues to apply.


31. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The updated Terms will be published on the Website with a revised "Last updated" date.

Changes will generally apply from the date they are published and will not retrospectively remove or reduce rights that have already accrued under an accepted order.

Where applicable law requires notice of a material change, we will provide that notice.

Your continued use of the Website after updated Terms take effect constitutes acceptance of the updated Terms for future use of the Website, to the extent permitted by law.


32. GOVERNING LAW

These Terms are governed by the laws of Queensland, Australia.

Subject to any mandatory law that provides otherwise, the courts of Queensland have jurisdiction in relation to disputes arising from these Terms or your use of the Website.

Nothing in this section prevents a consumer from exercising a right to bring proceedings in another jurisdiction where that right cannot lawfully be excluded.


33. DISPUTE RESOLUTION

If you have a concern about an order, product or service, please contact us first so that we have an opportunity to investigate and resolve the issue.

We will endeavour to respond within a reasonable time.

Nothing in this section prevents you from contacting a consumer protection agency, regulator, payment provider, court or other body where you are legally entitled to do so.


34. SEVERABILITY

If a provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down or severed to the extent necessary, and the remaining provisions will continue to operate to the extent permitted by law.

This section does not prevent a court or regulator from applying any remedy available under applicable law in relation to an unfair contract term.


35. NO WAIVER

If we do not immediately enforce a right or provision under these Terms, that does not mean that we have waived that right.

A waiver is only effective where expressly given by us in writing.


36. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our written consent, except where permitted by law.

We may transfer or assign our rights or obligations in connection with a sale, restructuring or transfer of the business, provided that doing so does not reduce your mandatory consumer rights.


37. ENTIRE AGREEMENT

These Terms, together with the applicable product listing, order confirmation, Refund and Returns Policy, Privacy Policy, Shipping Policy and any other policy expressly incorporated into the relevant transaction, form the agreement between you and us concerning your use of the Website and purchase of products.

Nothing in this section excludes or limits liability for misleading or deceptive conduct, fraud, pre-contractual representations that cannot lawfully be excluded, or any mandatory consumer right.

Where a specific product listing or order confirmation contains information that is inconsistent with these general Terms, the specific information applicable to that order will apply to the extent of the inconsistency, subject to applicable law.

Nothing in these Terms is intended to exclude, restrict or modify your rights under the Australian Consumer Law or any other law that cannot legally be excluded, restricted or modified.
